1. Introduction
1.1 These Terms and Conditions (“Terms”) govern your access to and use of La Sip List (the “Service”), an application that allows users to keep track of specialty coffee locations, drinks and personal coffee experiences, and to create a list of places they would like to visit.
1.2 By creating an account or using La Sip List, you agree to be bound by these Terms. If you do not agree with these Terms, you should not create an account or use the Service.
1.3 La Sip List is intended to provide users with a personal and curated way to organise their coffee experiences, including saving cafés, recording personal notes, scores and prices, and maintaining a list of cafés they wish to visit.
1.4 These Terms apply together with our Privacy Policy, which explains how we collect, use, store and protect your personal data.
1.5 These Terms, together with any policies or other terms expressly referred to in them, constitute the agreement between you and La Sip List governing your use of the Service.
2. Account Requirements
2.1 To use certain features of La Sip List, you must create an account.
2.2 When creating an account, you provide your email address, and your name if you choose to add one. You must provide information that is accurate and keep your account information up to date.
2.3 You sign in with Apple or with a link sent to your email address. La Sip List has no passwords.
2.4 You are responsible for keeping access to your Apple account or email secure, and for activity carried out through your account.
2.5 You must be at least 16 years old to create an account.
3. Using La Sip List
3.1 La Sip List allows you to save and organise specialty coffee locations, record personal coffee experiences, and maintain a list of places you would like to visit.
3.2 The Service includes features such as Sipped, which allows you to keep track of cafés you have visited, and Up Next, which allows you to maintain a list of cafés you would like to visit.
3.3 You may use La Sip List to record personal information about your coffee experiences, including notes, scores, prices, drinks and other information supported by the Service.
3.4 Certain features of La Sip List may use your device’s location information to provide location-based functionality. Use of these features may require you to grant the relevant device permission.
3.5 La Sip List is intended for personal use. You may use the Service to organise and manage your own coffee experiences, but you may not use it for unauthorised commercial purposes or resell access to the Service.
4. Technical Requirements
4.1 La Sip List is an iPhone app and requires a compatible device and an internet connection.
4.2 Certain features may require permission to access device features, such as your location.
4.3 You are responsible for ensuring that your device and internet connection meet the technical requirements necessary to use the Service.
5. Limitations on the Use of La Sip List
5.1 Your right to access and use La Sip List is personal and non-transferable. You may not sell, sublicense, rent, lease, lend, transfer or otherwise make your account or access to the Service available to another person.
5.2 You must use La Sip List lawfully and respect the rights of others. You must not use the Service to upload, distribute or otherwise make available content that violates applicable law or another person’s rights, including intellectual property, privacy or other personal rights. You must not impersonate another person or misrepresent your identity, or use the Service for fraudulent purposes.
5.3 You must not attempt to gain unauthorised access to La Sip List, another user’s account, or any systems or services connected to La Sip List. You must not interfere with, disrupt, damage or circumvent the security or technical operation of the Service, or upload malicious code or other harmful material.
5.4 You must not reverse engineer, decompile, disassemble or otherwise attempt to derive the source code or underlying structure of La Sip List, except where such restriction is not permitted by applicable law.
5.5 You may use La Sip List only in accordance with these Terms and for its intended purpose. You must not use the Service to harass, threaten or abuse others, or in any way that could harm La Sip List, its users, or the operation, security or availability of the Service.
6. Changes and Updates
6.1 La Sip List may change, update, add or remove features or functionality of the Service from time to time, including where necessary to improve the Service, maintain security, comply with applicable law, or respond to changes in technology.
6.2 Where we make material changes to the Service that significantly affect your use of La Sip List, we will provide reasonable notice where practicable.
6.3 You may provide feedback, suggestions or requests regarding the Service. We may consider such feedback when developing or updating La Sip List, but we are not obliged to implement any particular suggestion or requested change.
7. Information and Accuracy
7.1 La Sip List is a personal tracking and organisation tool. Information recorded in the app, including café information, prices, opening hours, ratings, notes and other details, may be incomplete, outdated or inaccurate.
7.2 User-generated information represents the personal experience or opinion of the user who entered it and does not constitute an endorsement, recommendation or guarantee by La Sip List.
7.3 You should independently verify important information, including opening hours, prices, availability and café services, before relying on it.
8. Pricing and Payments
8.1 La Sip List is free to use for up to 10 saved cafés (across Sipped and Up Next combined) and up to 2 drinks logged per café.
8.2 A paid subscription removes these limits. Its price depends on the country or region of your App Store account (currently €4.99 per month in Spain) and is always shown in the app and in the App Store before you subscribe.
8.3 Subscriptions are billed and managed entirely through Apple’s In-App Purchase system. Payment is charged to your Apple ID at confirmation of purchase, and the subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
8.4 You can manage or cancel your subscription at any time in your device’s App Store account settings. Cancellation takes effect at the end of the current billing period; we do not provide partial refunds for unused time within a period.
8.5 Refunds are handled by Apple in accordance with Apple’s own refund policies, not by us directly.
8.6 If we change subscription pricing, we will give notice before the change takes effect for existing subscribers, as Apple’s App Store rules require.
9. Service Availability and Support
9.1 We aim to keep La Sip List available and functioning reliably. However, the Service may occasionally be unavailable or affected by maintenance, updates, technical issues, outages or circumstances beyond our reasonable control.
9.2 Where reasonably practicable, we will try to provide advance notice of planned maintenance that is expected to significantly affect the availability of the Service.
9.3 If you experience a problem with La Sip List, you may contact us using the contact details provided in the Service. We will make reasonable efforts to review and respond to support requests, but we do not guarantee a particular response time or resolution time.
9.4 We do not currently provide guaranteed service levels, continuous availability or formal response-time commitments unless expressly stated otherwise.
10. Backups and Data Retention
10.1 La Sip List may maintain technical backups of data where necessary to support the security, reliability and operation of the Service. The timing, retention and deletion of such backups may vary depending on technical and operational requirements.
10.2 Technical backups are not intended to provide users with a guaranteed method of recovering deleted accounts or User Content. Where available, users should use the backup and export functionality provided by La Sip List to maintain their own copy of information they wish to retain.

11. User Content
11.1 La Sip List allows you to add personal content, including café notes, ratings, prices, drink information and photographs (“User Content”).
11.2 You retain ownership of the User Content you create and upload to La Sip List. La Sip List does not acquire ownership of your User Content by virtue of your use of the Service.
11.3 You represent that you have the necessary rights and permissions to upload and use your User Content and that your User Content does not infringe the intellectual property, privacy or other rights of any third party or violate applicable law.
11.4 You grant La Sip List a limited, non-exclusive, worldwide licence to store, reproduce and display your User Content solely to the extent necessary to provide, operate, maintain and improve the Service.
11.5 You must not upload content that is unlawful, fraudulent, defamatory, abusive, discriminatory, invasive of another person’s privacy, or otherwise violates another person’s rights.
12. Intellectual Property Rights
12.1 You acknowledge that you do not acquire any ownership or other intellectual property rights in or to La Sip List or its Service, except for the right to access and use the Service in accordance with these Terms. La Sip List and its licensors retain all rights, title and interest in and to the Service and its intellectual property, including its software, source code, design, interface, branding, logos, trademarks, graphics, text, visual assets and other materials provided as part of the Service.
12.2 Content and materials forming part of the Service may be owned by La Sip List or licensed to us by third parties.
12.3 Except where permitted by these Terms or applicable law, you must not copy, reproduce, modify, distribute, sell, license, publish or otherwise exploit La Sip List or its intellectual property without our prior written permission.
13. Personal Data
13.1 La Sip List processes personal data in accordance with applicable data protection laws, including Regulation (EU) 2016/679 (the “General Data Protection Regulation” or “GDPR”).
13.2 Information about the personal data we collect, the purposes and legal bases for processing, how long data is retained, the third parties that may receive data, international transfers where applicable, and your data protection rights is set out in our Privacy Policy.
13.3 Where La Sip List uses third-party service providers to process personal data on its behalf, we will take appropriate steps to ensure that such processing is carried out in accordance with applicable data protection requirements.
13.4 You may exercise your applicable data protection rights in accordance with the Privacy Policy. These rights may include access, rectification, erasure, restriction of processing, data portability and objection, depending on the circumstances and applicable law.
13.5 How your data is handled, including the short technical reports the app records when something goes wrong, is described in our Privacy Policy.
14. Service Disclaimer
14.1 La Sip List is provided on an “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free or available at all times.
14.2 We will make reasonable efforts to maintain the Service and address significant technical issues within a reasonable time.
14.3 We do not provide any guarantees or warranties beyond those required by applicable law.
15. Third-Party Rights
15.1 La Sip List respects the intellectual property and other rights of third parties. Content and materials forming part of the Service may be owned by La Sip List or licensed to us by third parties.
15.2 If you believe that content or material available through La Sip List infringes your rights, you may contact us using the contact details provided in the Service so that we can review the matter.
16. Liability
16.1 To the fullest extent permitted by applicable law, La Sip List shall not be liable for indirect or consequential losses arising from your use of the Service.
16.2 We are not responsible for losses or issues resulting from your misuse of the Service, your failure to keep your account credentials secure, or circumstances outside our reasonable control.
16.3 Nothing in these Terms excludes or limits any liability, right or remedy that cannot legally be excluded or limited under applicable law.
17. Term and Termination
17.1 The duration, renewal, cancellation and termination of paid subscriptions are set out in Section 8 (Pricing and Payments).
17.2 We may suspend or terminate your access to La Sip List if we reasonably believe that you have violated these Terms or applicable law, or where suspension or termination is reasonably necessary to protect La Sip List, its users, or our legal rights.
17.3 Where appropriate, we may provide notice before suspending or terminating your access. However, we may suspend or terminate access immediately where necessary to protect La Sip List, its users, or our legal rights.
18. Account Closure and Data
18.1 You may delete your La Sip List account at any time, from the app.
18.2 When you delete your account, your account and its associated data are deleted straight away, and you will no longer be able to sign in. Deletion cannot be undone: once deleted, your account and data cannot be recovered through La Sip List.
18.3 When you delete your account, you may request a copy of your data where such functionality is available.
18.4 We will delete personal data in accordance with our Privacy Policy and applicable data protection laws, subject to any information we are required or permitted to retain by law.
19. Governing Law and Disputes
19.1 These Terms are governed by the laws of Spain, except where mandatory consumer protection laws in your country of residence provide otherwise.
19.2 Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent courts in accordance with applicable law.
